J. Todd Malaise

Todd Malaise is a Personal Injury Attorney with 28 years of experience and has been with Davis Law Firm since 2021. Upon graduating from St. Mary’s School of Law in 1996, he founded and managed Malaise Law Firm and managed a staff of 10 attorneys and 35 support staff. Todd has extensive litigation and appeals experience. He has appeared before the United Supreme Court and has also argued and briefed multiple appeals before the Fifth Circuit Court of Appeals, the Texas Supreme Court, the Fourth Court of Appeals, and multiple federal district courts.

Todd has an impressive win record since 2015, winning all 6 of his appeals, including appeals at the United States Supreme Court, Texas Supreme Court, Fifth Circuit Court of Appeals, and the Texas Fourth Court of Appeals. In one of the appeals, the U.S. Supreme Court ruled (9-0) in his client’s favor reversing the Fifth Circuit’s 3-0 ruling against his client. In another one of his other appeals (Methodist Healthcare Sys. Of San Antonio v. Dewey), he established new precedent in San Antonio that made it easier for persons injured on the premises of hospitals to sue them for damages. During his 27-year career, Todd was the lead attorney in over 45 published legal opinions.
